The workshop featured in depth discussions on the future of broadband and the opportunity to "admire and acquire" best practices employed by PUDs providing broadband service. During the Workshop, attendees were challenged to post on a vision board their vision for the future of broadband. Responses included everything from preparing for quantum computing to developing rural tech centers to refining the terms "unserved" and "underserved." Whatever the future brings, PUDs are well positioned to not only be part of the future but to be leaders in defining the future of broadband in Washington State. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">This was also Public Power Week, an annual event recognizing the value public utilities provide communities. I had the opportunity to attend a couple Public Power Week events at Mason PUD #1 and Grays Harbor PUD. Viebrock and Ronald E. Skagen invited the community to learn about and see the renewable hydrogen production facility in Baker Flats. Under construction since March 2021, the District is close to commissioning the first renewable hydrogen production facility in the nation owned and operated by a public utility.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">General Manager Gary Ivory welcomed the community to the event on National Hydrogen Day during Public Power Week, celebrating the benefits of both. When describing why the District took on this project Ivory said “How can we prepare our community to be ready for the policies changes the state has made? The investment in this plant not only produces a fuel but it helps us preserve our Wells Dam asset that is so important to our community.”</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The pilot project will provide flexibility to Douglas PUD operations at their Wells Hydroelectric Project. Generation requests can be sent to the hydrogen electrolyzer to reduce the mechanical adjustments necessary at the Wells Hydroelectric Project to balance the grid. This will reduce the maintenance necessary on the turbine units and associated equipment.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Ivory went on to praise the innovation of the District, “Douglas PUD has a history of being innovative from building a dam on the Columbia River to stringing fiber optics around the county. We have been around for over 80 years with the authority to provide people with electricity. I don’t think 80 years ago they would have ever thought little Douglas PUD would be doing a cutting edge project like this. Dougals PUD has this built in innovation, it’s part of our DNA.”</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Hydrogen is created by a process that separates the hydrogen and oxygen molecules in water through electrolysis. The 5 megawatt PEM electrolyzer is able to produce 2 metric tons of hydrogen a day at full capacity. The site is able to accommodate expansion if the pilot project is successful.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">After Commissioners cut the ribbon, staff took questions from the community ranging from safety to economics to technical operations. Upon leaving the facility, the community could get an up-close look at a Toyota Mirai fuel cell car. The District opened the state’s first hydrogen fueling station at their East Wenatchee location in June 2025. After the coalition of utilities and organizations called for a collaborative path forward, raising concerns about harm to the Federal Columbia River Power System, the State of Washington filed notice in court stating, "In light of changing circumstances, and in order to best serve the State’s interests in this matter as it proceeds forward, the State hereby announces to the Court and all parties the State’s intent to shift from unaligned to Plaintiff-aligned amicus.” The State of Washington has been an unaligned friend of the court for four years. Amicus means "friend of the court." They do not have the same status as plaintiffs, defendants or intervenors but can file briefs in support of the plaintiffs. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The State of Oregon and other plaintiffs moved to lift the stay on litigation after the Trump Administration withdrew from the 2023 "12/14 Agreement" between the U.S. Government and "Six Sovereign" parties. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The letter urged the Governor not to join the lawsuit. "To date, Washington has not been a plaintiff in this litigation, and we strongly urge the state to maintain that posture in the future, including not supporting motions brought forward by plaintiffs that would dramatically harm the system." The letter highlighted the importance of the federal power system in meeting the state's clean energy goals especially as utilities face resource adequacy challenges. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The letter called for a "collaborative path" forward discussing and acting on workable solutions for the state and region rather than "continuing down the divisive path of litigation." The letter states, "We are reaching out to you so that you know we believe there is a better way, and that a decision to join the litigation as a plaintiff or active supporter of court actions that would dramatically impact the multiple benefits that come from the multipurpose hydropower system would run counter to the interests of your constituents in the State of Washington who rely on the FCRPS and could considerably set back the state’s interests in securing its clean energy future. Given the quantitative and qualitative data suggesting that our energy future is uncertain, we believe now is the time to come together to chart a sustainable path toward effective solutions that protect salmon and maintain affordable and reliable hydropower, which is essential for millions of people in Washington and the Pacific Northwest. There is a better way to meet those objectives than in a courtroom, and we look forward to working together with the State of Washington to help achieve those successes." The group is directed to consider possible policy recommendations that "balance industry growth, tax revenue needs, energy constraints, and sustainability." Workgroup members include representatives from Chelan and Grant County PUDs. The workgroup recommendations can be accessed <a rel="noopener" href="https://www.dor.wa.gov/sites/default/files/2025-09/DCWGDraftRecommendations9_22_25Mtg.pdf." target="_blank">here</a>.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">WPUDA's comments focused on several categories outlined in the draft recommendations including clean energy and climate policies, load forecasting, enhanced transmission capacity, streamlining permitting for transmission resources, water resources, and strengthening ratepayer protections. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">WPUDA agreed with a recommendation to "reassess carbon reduction timelines when new data or reliability analyses suggest potential grid risk" highlighting recent analysis that have heightened concerns about grid reliability in the face of growing load, shuttering of dispatchable resources, and transmission constraints. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">WPUDA urged the workgroup recommendations on load forecasting to utilize individual utilities with local knowledge which are "best suited to assess the local needs into the future" rather than attempting to manage it through a statewide effort. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The draft recommendations call for establishment of a Transmission Authority which WPUDA pointed out will provide little benefit absent permitting reform. WPUDA supported recommendations for streamlining siting and permitting of transmission resources including limiting permitting requirements associated with reconductoring using existing transmission right-of-ways to increase capacity. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">WPUDA objected to recommendations for ratepayer protections that would undermine the authority of local utility governing boards to set retail rates appropriate to their circumstances. WPUDA pointed out that PUD governing boards already have, and exercise the authority to ensure that residential and commercial ratepayers are protected from costs created by new large loads.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">In addition, WPUDA opposed a recommendation requiring an "overly burdensome" annual assessment comparing past load forecasts to actual outcomes (backcasting). With this year’s theme, <em>“Crossroads of Telecom: Charting a Course for the Future,”</em> participants explored how Washington’s public broadband providers are navigating a rapidly changing policy and funding landscape. Hosted by Mason PUD 3, the two-day event featured engaging panels, timely discussions, and collaborative networking opportunities—including a reception at the Little Creek Casino Resort. Attendees shared best practices, examined national broadband trends, and considered how PUDs can continue to lead the way in delivering equitable, future-ready broadband service across the state.</p><p style="line-height: 140%;"><strong> </strong></p><p style="line-height: 140%;">The workshop opened with a keynote presentation from Jake Varn, Associate Manager of the Broadband Access Initiative at The Pew Charitable Trusts. Varn offered a national perspective on broadband policy, highlighting how broadband access continues to shape communities through improved education outcomes, lower healthcare costs, and expanded telehealth use. Varn also provided updates on federal broadband programs, including changes to the BEAD (Broadband Equity, Access, and Deployment) program, and noted that as BEAD funding rolls out, it will be up to states to address remaining service gaps. Many states, he said, are redefining “served,” “unserved,” and “underserved” to increase minimum speeds as well as include affordability and scalability, ensuring broadband investments meet long-term needs.</p><p style="line-height: 140%;"><strong> </strong></p><p style="line-height: 140%;">Two PUD-focused panels examined both retail and wholesale broadband models. line-height: 140%; text-align: left; word-wrap: break-word;"> <p style="line-height: 140%;"><strong>Senate confirms FERC nominees</strong></p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The Senate on Tuesday confirmed Laura Swett and David LaCerte to serve on the Federal Energy Regulatory Commission, filling the remaining seats on the panel whose duties include regulating interstate energy transmission and creating reliability standards for the bulk power system</p><p style="line-height: 140%;">LaCerte and Swett’s confirmation came as part of an en bloc package (S Res 412) of nominees passed by the Senate by a vote of 51-47. LaCerte would complete the final months of a term ending in June 2026 and Swett would serve the majority of a five-year term ending in June 2030.</p><p style="line-height: 140%;">The vote also puts a Republican majority on the five-person commission.</p><p style="line-height: 140%;"><br>LaCerte and Swett are both Republicans and will join Republican commissioner Lindsay See and Democratic commissioners Judy Chang and David Rosner, who were all confirmed last year. Rosner is currently the chairman. </p><p style="line-height: 140%;">Swett and LaCerte faced questions at their nomination hearing before the Senate Energy and Natural Resources Committee over how they would guarantee the agency's independence in light of the Trump administration’s firing of independent commissioners. Both said that they would follow the law.</p><p style="line-height: 140%;">“I personally welcome modification of Humphrey's executor,” LaCerte said, referring to a Supreme Court case that set a precedent protecting independent agency heads from firings without cause. The justices have preliminarily allowed President Donald Trump to remove officials in emergency cases over recent months, signaling a possible end to the precedent.</p><p style="line-height: 140%;">Both commissioners also said FERC can’t discriminate against any form of energy in response to questions from Democratic senators. The Trump administration has expressed hostility toward wind and solar energy projects, but both LaCerte and Swett said the law requires FERC to remain neutral.</p><p style="line-height: 140%;">Swett previously worked at the agency for six years, including in the Office of Enforcement and as an adviser to two commissions, and was most recently litigation counsel at the law firm Vinson and Elkins.</p><p style="line-height: 140%;">LaCerte has worked at the Office of Personnel Management since January. He also worked at OPM during Trump's first term and was an adviser and executive counsel at the U.S. Chemical Safety and Hazard Investigation Board.</p><p style="line-height: 140%;">Both nominees advanced out of committee 12-8 last month, with Angus King, I-Maine, joining all of the Republicans to back them. </p><p style="line-height: 140%;">Ranking member Martin Heinrich, D-N.M., said that he would have supported Swett were it not for the Trump administration attacks on renewable energy, but said LaCerte didn’t have the necessary background in energy law and regulation.</p><p style="line-height: 140%;">Swett’s seat was previously held by Mark Christie, a Republican and former chairman of the commission, who was at the end of his five-year term and resigned in August. FERC commissioners can serve for six months after their term ends if no replacement is confirmed.</p><p style="line-height: 140%;">LaCerte’s seat was previously held by Willie L. Phillips, a Democrat who was chairman of the commission from January 2023 until Trump’s inauguration. Phillips said he was asked to resign by the Trump administration. Josh Hawley, R-Mo., who has sponsored or co-sponsored bills seeking to hold companies responsible for their AI systems, said that “the status quo is not acceptable.”</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The efforts stand in contrast to the push by Cruz, the Senate Commerce chair, who has issued his own plan to treat AI with a “light” regulatory touch and introduced a “sandbox” bill (S 2750) that would let companies seek decadelong waivers from federal regulations. </p><p style="line-height: 140%;">At a hearing shortly after he released the bill and framework, Cruz called AI “transformative” and said that “America is in an AI race with China.”</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Cruz has also indicated he’s still interested in a moratorium on state AI regulations, although he hasn’t announced a plan for how the provision could move, whether as part of a must-pass bill or on its own.</p><p style="line-height: 140%;"><br>A week after Cruz released his AI framework, Sen. Mark Kelly, D-Ariz., offered his own plan, "AI for America," which would use the financial gains of AI to fund job programs and energy infrastructure. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Kelly’s plan, which does not yet include introduced legislation, would create a fund “fueled by contributions from leading AI companies” to pay for a variety of solutions to AI-driven problems, including programs to retrain workers who lost their jobs due to AI, as well as higher unemployment payments. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Under his plan, Kelly would put the funding of new energy infrastructure for data centers onto companies, rather than local utilities. The plan includes a provision that would prevent over 1.7 million acres from being considered for coal leasing.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The Senate took up a second resolution (H J Res 105) in the evening, voting 50-45 to vacate the BLM's North Dakota Field Office RMP prohibiting development of certain coal, oil and gas resources in the state.</p><p style="line-height: 140%;"><br>The administration said it supports the resolutions in a September statement of administration policy.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Montana's congressional delegation, all of whom supported the measure, say the Miles City plan would harm the state's economy.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Sen. Tim Sheehy, R-Mont., said the nation should be looking to the Montana coalfields in order to provide "baseload, reliable" power. </p><p style="line-height: 140%;">Senate Energy and Natural Resources ranking member Martin Heinrich, D-N.M., said the Senate was breaking with precedent by using the Congressional Review Act and ignoring the public comments filed on the plans. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The Biden administration finalized the RMPs in its final weeks after the 2024 election. It said in a letter to House Natural Resources ranking member Jared Huffman, D-Calif., that the RMPs weren't rules for the purposes of the CRA.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The Government Accountability Office, however, said in June that the plan and similar RMPs were rules, allowing Republicans to move forward with the nullification measures.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">The Senate's votes Wednesday also align with the Trump administration's recent policy moves. He would fill a seat previously held by Christopher Hansen, who was fired by Trump in mid-June, for a term that expires on June 30, 2029.</p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Nieh is affiliated with Southern Nuclear in Alabama, where he is the company's vice president of regulatory affairs, but has been on an assignment with the Institute of Nuclear Power Operations for over a year. His career includes nearly 20 nonconsecutive years of service with the NRC, including stints as director for three separate divisions.</p><p style="line-height: 140%;">Nieh’s nomination seemed to receive slightly more attention from senators as members on both sides of the aisle agreed that the build-out of nuclear power has potential to help address rising energy demand. </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">“Strong, unified leadership at the NRC will help provide the necessary confidence in the industry and the public that we need to build more nuclear safely and quickly and to meet our energy needs,” Chairman Shelley Moore Capito, R-W.Va., said in her opening remarks. </p><p style="line-height: 140%;">“A slate full of five commissioners who are all aligned with ambitiously implementing the bipartisan ADVANCE Act and Executive Order 14300 will provide that confidence,” she added. “The commission and the NRC staff working on these efforts must carry out reform initiatives without losing sight of the agency's core licensing responsibility and safety mission, and deliver updated regulations that are durable and thoughtful.” </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Whitehouse agreed about the increasing demand and need for additional, safe deployment of nuclear power, but cautioned Nieh that the agency has changed under the Trump administration.</p><p style="line-height: 140%;">“I appreciate very much your willingness to return to public service, to an agency where you have devoted nearly 20 years of your career,” Whitehouse said. “But be warned, this is not the same agency you left four years ago.” </p><p style="line-height: 140%;"> </p><p style="line-height: 140%;">Whitehouse lamented the loss of institutional and technical knowledge at the commission amid widespread staffing cuts and warned of reported attempts by Department of Energy and Department of Government Efficiency staff to exert undue influence on the NRC. </p><p style="line-height: 140%;">Other committee Democrats echoed Whitehouse’s concerns about the agency’s independence, including Sens.
